Contractual Enforcement and Interpretation:
Documents prepared by the developer of a property can be rather vague, complex and/or fail to address the specific needs of the Unit Owners of the Association. We regularly draft and interpret association documents, in conjunction with Ohio law, in order to provide legal opinions for amending and/or enforcing the same.
Covenant Enforcement/Collections for Failure to pay Assessments:
In cases of covenant violations or the failure of a Unit Owner to pay assessments, we attempt to enforce any violations of the same and strive to recoup the cost of legal fees from the Unit Owner. We attempt to facilitate a timely resolution with the Unit Owners in order to preserve the valuation of the complex as a whole, and provide board members the legal support and information needed to enforce the same.
Though we strive to prevent lawsuits, we will engage in litigation when necessary, especially regarding collections, enforcement of covenants, foreclosure defense and/or pursing foreclosures.
